What is a trademark?
A trademark, as one of several types of intellectual property protection, constitutes a sign that distinguishes the goods and services of one trader from those of others.
For it to be registered as a trademark, it must be capable of being represented graphically. You can register your trademark in Hong Kong under two conditions: you are already using your mark, or you intend to use it soon. Using the trademark actively is especially crucial as registered trademarks that have not been employed continuously for at least three years may be revoked on the grounds of non-use.
Benefits of registering
a trademark.
The benefits of registering a trademark are two-fold. First, it provides a legal presumption of ownership and exclusive rights to use the trademark in Hong Kong or other jurisdictions. Second, it gives the trademark owner the right to bring up a suit against any third-party infringing on the trademark.
